Interpretation and Definitions

Interpretation

Words with initial capitalization have specific meanings defined under the following conditions.

Definitions

  • Agreement: This End-User License Agreement (EULA) that governs the relationship between You and the Company regarding the use of the Application.
  • Application: The software program provided by the Company, downloaded through an Application Store to a Device, named Total Ink Solutions.
  • Application Store: The digital distribution services (e.g., Apple App Store or Google Play Store) where the Application is downloaded.
  • Company: Total Ink Solutions, 200 South Newman Street, Unit 5, Hackensack, NJ 07601.
  • Content: Any text, images, or other data that can be posted or shared by You through the Application.
  • Device: Any hardware that can access the Application, such as a computer, cellphone, or tablet.
  • Third-Party Services: Any services or content provided by third parties that may be accessible via the Application.
  • You: The individual or entity using the Application.

Acknowledgment

By clicking "I Agree," downloading, or using the Application, You agree to this Agreement. If You do not agree, do not proceed with the installation or use of the Application. This Agreement is a legal document between You and the Company, and it governs the use of the Application.

License

Scope of License

The Company grants You a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application for personal, non-commercial purposes under the terms of this Agreement.

License Restrictions

You agree not to:

  • License, sell, or commercially exploit the Application.
  • Modify, reverse engineer, or create derivative works of the Application.
  • Remove proprietary notices.

Content

Content Restrictions

You are solely responsible for any Content shared via the Application. Prohibited Content includes, but is not limited to:

  • Unlawful or offensive material.
  • Defamatory or discriminatory content.
  • Spam or malicious software.

Intellectual Property

All intellectual property rights in the Application are owned by the Company. You may not copy or use any elements of the Application without prior written consent.

Updates and Modifications

The Company may modify or discontinue the Application at any time. Updates to the Application are subject to the terms of this Agreement.

Privacy Policy

Your personal data is collected and handled in accordance with our Privacy Policy. By using the Application, You consent to the terms of the Privacy Policy.

Term and Termination

This Agreement is effective until terminated by You or the Company. Termination occurs when You uninstall the Application or if You violate the terms of this Agreement.

Limitation of Liability

The Company is not liable for any indirect or consequential damages resulting from the use of the Application. Liability is limited to the amount paid for the Application.

Changes to this Agreement

The Company reserves the right to modify this Agreement. Continued use of the Application indicates acceptance of changes.
